Doctor who said Britney Spears had dementia should be fired: lawyer

A trustee’s lawyer involved in the Free Britney movement has claimed that the doctor who lawyers claimed diagnosed the pop star with dementia in 2008 must testify before Jamie Spears has a chance to isolate his daughter, according to court documents.

Although the guardianship has ended, financial details are still in the works, including who will pay the attorneys who were retained during the guardianship. In the lead-up to a controversial hearing, Jamie Spears has asked for Britney Spears to be fired over allegations that she was subjected to him via social media.

In a brief note about friends in support of the pop star on Monday, attorney Lisa McCarley said Britney “is the last person on earth to be impeached in this case.”

“The first person on earth to be deposed is Dr. James Edward Spare,” McCarley wrote. “After all, it was Dr. Spar’s legendary advertisement that put Britney Jean Spears under the control and guard of James B. Spears, despite her objections, in the first place.”

In the brief, MacCarley retracted recent filings from Jamie’s legal team requesting Britney Spears’ removal over allegations she made about her father on Instagram recently — including allegations that he forced her to draw blood on occasion as well as restricting access to required pain medications.

Britney Spears has been on guard for 13 years who has given a handful of people, including her father, control over her personal, medical and financial decisions.

On September 7, Jamie Spears filed a petition to end Britney Spears’ guardianship, which the pop star’s legal team called a “tremendous” legal victory. The regency was officially terminated on November 12.

As part of the ongoing cases now before the courts, Britney’s legal team has claimed that in a 2008 medical report, Dr. Spar diagnosed the singer with dementia and did not have the ability to hire her own lawyer. He has denied meeting with the pop star. Spar did not immediately respond to an Insider’s request for comment.

This diagnosis paved the way for her father to take over as trustee and Samuel Ingham to become the court-appointed attorney for Britney Spears, MacFarley said, and he’s on a steady track with Jamie.

Specifically, McFarley said that all lawyers and experts who testified in a closed session on February 4, 2008 about Britney’s welfare should be forced to oust him, and the resulting medical report – with the revisions – should be made public.

Who agreed to pay Mr. Ingham $10,000 a week?” MacFarley Books. “It is time we all learned the truth about the judges and lawyers who left Britney, without a lifeline, under the control and guard of a violent male relative with a long history of abusive and dysfunctional behaviour.”

McFarley told Insider via email that there was “no basis” in law “to deny Jimmy Spears’ attorneys the opportunity to impeach Britney,” and said that “Britney’s legal team’s focus on Jamie is absurd, if not tragic.”

In the documentary “Britney vs. Spears,” the producers claimed they got a Dr. Spar stated that “Britney Jane Spears lacks the ability to retain and direct counsel.”

“[She] She lacks the ability to understand or manage her own finances without undue influence,” the report states, according to the producers of the documentary. The report was released on March 5, 2008, weeks after Jimmy was appointed as a temporary portfolio.

Dr. Spar sat down for an interview with the documentary’s producers and said he was a “retired elderly psychiatrist”, and still does “occasional counseling to lawyers, including sometimes contested guardianship”.

At Wednesday’s hearing, a judge may rule on issues of whether Britney Spears needs to pay Angham and other parties’ attorney fees, her father’s guardian’s fees, and whether Jamie Spears will be able to compel his daughter to testify.
